State Representative Steve Toth is a small business owner representing South Montgomery County in the Texas House of Representatives. With a background in business consulting and construction, Toth has been quoted in the Houston Chronicle Business section and his construction firm has been featured several times in his industry’s trade publications. He and his wife currently run My Pool Xpert, a pool service company.

Steve and his wife of 37 years, Babette, have three children, and are grandparents to twins. The Toths have lived in Montgomery County for over 20 years. As an ordained minister, Steve served as a family life pastor at Fellowship of The Woodlands (now known as The Woodlands Church) and teaching elder at WoodsEdge Community Church. He currently serves as chairman of the board of Mighty Oaks Foundation, ministering to veterans with post-traumatic stress disorder (PTSD).     

Representative Toth was first elected to serve House District 15 in 2012, and was re-elected in 2018 and 2020. In the Texas House, Representative Toth passed the CSCOPE Transparency Act which led to the eventual elimination of this Common Core in Texas schools. Rep. Toth gained a reputation as a stalwart conservative by authoring the Texas Firearms Protection Act to stop federal overreach in Texas. Toth has successfully passed laws addressing county government ethics reform, parental visitation rights at schools, and the elimination of Critical Race Theory in the classroom, to name a few.

Additionally, Toth earned the distinction of “Taxpayer Champion,” earning an “A” score from Texans For Fiscal Responsibility. He was named a “Courageous Conservative” by the Texas Conservative Coalition and a “Faith & Family Champion” by Texas Values. Rep. Toth was awarded “Top Rated Conservative in the Texas House” by the Texas Eagle Forum, earned a 100% rating from Texas’ chapter of Concerned Women for America, and was scored the second highest in the Texas House by the Young Conservatives of Texas. Out of Texas' 150 state representatives, Toth has the third most conservative voting record (based on a 2021 Rice University Study). 

Steve Toth has been a contributor on KTRH, American Family Radio, OAN, The First TV, Real America's Voice News, Newsmax, ABC, CNN, and Fox News.

Representative Toth serves on the powerful Appropriations committee, which is tasked with crafting the state budget. He also serves as Vice Chairman of the Committee on Resolutions Calendars and as a member of the Committee on Agriculture & Livestock.

General

This is a Republican primary race.  Do you promise, if elected, to abide by the RPT platform? And if not, please enumerate what problems you have.

Yes.  As a member of the Texas Freedom Caucus, most all of the legislation that supported GOP priorities came from our caucus.

Do you support Interposition and Nullification as it pertains to Texas State Sovereignty?

Yes.  The history of all of my legislation has been to undercut Federal power that the Tenth Amendment reserves for the States.

Please list the pros & cons of how the Texas House chooses its Speaker and Committee Chairmen and what, if any, changes you propose.

The Texas Freedom Caucus changed the Republican Caucus bylaws, which forced Joe Straus to resign the following year.  The Republican Party asked for a secret ballot, and I will continue to support that.

What differentiates you from your opponents?

ALL candidates for public office claim to be constitutional conservatives.  The problem is that once elected the swamp swallows them whole.  I am the only member of the Texas House that has a proven record of growing more conservative.  According to the Rice University Study, which tracks every single vote, I was 20th most conservative among the entire 150-member House during the 83rd Session.  During the 86th Session, I was 15th.  This current session I was the 3rd most conservative member of the Texas House.  

Please describe your views on gambling as a funding source for education and other budget items, and whether gambling should be expanded or reduced. Why?

The Lotto is a scam to take money and exploit poor people.  Their slogan "a dollar and a dream" is disgusting.  This past year I vetoed the Texas Lottery's goal to double their marketing budget.

Budget

Please describe your plan for balancing the Texas budget. What budget items need to be cut and what taxes and fees need to be increased?

The governor's incentive relocation budget along with the film industry budget needs to be eliminated.  There are billions of dollars of pork giveaways that can and should be cut. I have always voted against these expenditures.  Property taxes could be eliminated tomorrow by ending sales tax exemption carve-outs for companies.  Texas takes enough in revenue to eliminate the property tax with a fair tax that's more equitable.

Spending

Will you commit to reduce the size of government at all levels by a specific date, so that total spending would not exceed 8% of total personal income (which includes corporations and other business entities as well as individuals) at the federal level, 5% at the state level, and 5% at the local level?

Yes.  I have and I will.

Taxes

What is your view regarding reducing or eliminating property taxes in favor of increased sales taxes and increased user fees?

I agree, only we don't have to increase sales tax.  We do need to eliminate crony capitalism carve-outs.

Would you be wiling to abolish the property tax and or income tax in favor of a consumption tax?

Yes.  See above.

Debt

What problems do you see with how the Legislature creates Improvement Districts and Special Purpose Districts and what solutions do you propose? Specifically address indebtedness.

Give taxpayers the ability to eliminate them by a vote.

What do you propose to solve the problem of underfunded liabilities, such as the state employee retirement fund?

Each year the State of Texas sets priorities.  Unfortunately, unfunded mandates don't seem to be one of them.  TRS-Care is another underfunded program the legislature ignores each year.  We have all the money we need with current revenue streams.  This is about taking care of needs before wants. 

2nd Amendment - guns

What firearm and carry restrictions should Texas government require of citizens? Why?

None.  The Second Amendment is our guidance.

5th Amendment- due process

The residency law, as it pertains to Voting in Texas, is ambiguous at best. Some have been selectively prosecuted, while others receiving compensation (cheap rent), have been allowed to skate. Will YOU carry legislation that clarifies this ambiguity and if so, generically speaking, what will it say?

I would gladly carry legislation that clears this up while also narrowing the provision to prosecute.

Other civil liberty

Do you support or oppose limiting the power of eminent domain to public works purposes? Support Oppose

Oppose.  There should be no provision that allows government to take private property.

Education

If you were able to fix how public education was funded, how would you do it and why?

All funding would come from the state and it would be disbursed at the direction of parents.

When did you first become aware of the progressive's CScope/Common Core/CRT/SEL/IB and what is your plan going forward to stop it?

I introduced and passed legislation in the 83rd Session that put an end to CSCOPE and I also introduced and passed HB 3979 that bans CRT in Texas.  The bill is model legislation being used all over the country.  There is still much to be done including a parent portal allowing Mom and Dad to see in real time what is being taught in the classroom.

Ethics

Is there anything in your background of an embarrassing nature that should be explained before your election? Arrests/Convictions? Bankruptcys?

No.

Health care

Will you oppose the use of state funds to distribute abortion-causing drugs, such as RU-486?

Yes, and I have co-authored legislation to do so. 

Immigration

Will you vote to prohibit the use of state funds to teach immigrants in their native languages, instead of English (so-called bilingual education)?

Learning by immersion is the proper way to teach English in our schools. We should not appropriate funds to enable people to break the law.

Transportation

Please fully describe what methods of funding roads in Texas you will support and oppose, and give your reasoning. Please discuss all revenue sources, tax diversions, tolls, and debt.

First, it needs to be a greater priority. 30 years ago roads were 12% of the budget, now they're roughly 4%.  If toll roads are to be built, that decision needs to be left up to voters.  The same goes for P3 money.  Taxpayers need to approve them.  

What will you commit to do to prevent Texas Central Railway from exercizing Emminent Domain to destroy Texas farms and ranches?

I have been at the front of the line in combating TCR with legislation and activism to stop this crony capitalism project.  My Dad lost his business to the criminal act of eminent domain.  It's personal for me.

Other

What is the most important legislative problem you see for the next legislative session and what do you propose to solve it?

I will continue to push for a ban on vaccine mandates. For my efforts, I will tighten up the ban on CRT and work towards eliminating the gender transitioning of minors.

Do you support or oppose requiring schools, public health departments or any medical personnel to secure consent from a parent or legal guardian before prescribing, dispensing or administering contraceptive drugs or devices to a minor? Support/Oppose

Schools should not be permitted to dispense contraceptives, period.  It's not an issue of parental consent.  Schools need to walk away from being social activists and leave the teaching of values to parents or guardians.  

Please list the top issues where you oppose federal government intrusion into Texans' lives and how you intend to oppose such intrusion

Immigration Law - Texas needs to deport anyone who comes here illegally.  Don't hand them over to ICE, just send them back across the border. 

Build Trump's Wall - I voted to appropriate an additional $1.8 billion for the wall.

Second Amendment - Texas should nullify all Federal gun laws.

Abortion - Texas needs to abolish abortion and refuse to abide by Roe.

Fourth Branch of Government Laws - The fourth branch of government pertains to bureaucrats who create laws with criminal penalties with no approval of either the State or Federal Government.  Texas needs to nullify or interpose on all of them.
