Representative Toth was first elected to serve House District 15 in 2012, and was re-elected in 2018 and 2020. In the Texas House, Representative Toth passed the CSCOPE Transparency Act which led to the eventual elimination of this Common Core in Texas schools. Rep. Toth gained a reputation as a stalwart conservative by authoring the Texas Firearms Protection Act to stop federal overreach in Texas. Toth has successfully passed laws addressing county government ethics reform, parental visitation rights at schools, and the elimination of Critical Race Theory in the classroom, to name a few.

Questionnaire

General

Please describe the qualifications and experience that make you the best candidate for the office you are seeking.

I served in the Texas House securing the 2nd most conservative scores of the 83rd Session.  I worked hard to pass the CSOPE (common core) Transparency bill that became law in 2013. I did not bend to the pressure of Austin Cartel and scored among the most conservative members of the Legislature.

What should be America's course of action in regard to Iran's nuclear capabilities?

Reestablished sanctions against Iran.

If that doesn't yield any results at some point a military response is in order

Iran can not obtain a nuclear devise that endangers Israel or the US.

If we were attacked again in a manner similar to 9/11, what should be our response and what, if anything, should we do differently than we did before?

Islamist Fundamentalists goal is to drag us in to a Middle East ground war.  That's the last thing America should do.  The proper response is to pound any terror-sponsoring nation in to the ground with the aid of Force Recon units and air power.

Why does the US need all these bases overseas?

I don't know that we do need all the bases we currently have.  That said, projecting military power is essential to maintain peace.

Please discuss what America's proper relationship to Israel should be using past and present relationships for comparison.

Israel is the only stable democracy in the Middle East.  A secure Israel means for a peaceful Middle East. Scripture says; "I will bless those who bless you and curse those who curse you"

America must stand with and for Israel.

Under what conditions should the US take military action in the Middle East? - What good did the Vietnam war, Korean War, Afghanistan war, Iran war accomplish? Who benefited? Who lost?

War is to kill people and break things.  Where there is no clear objective, there is also no defined timetable to leave or any realistic exit stratgey.  The only Middle East action I would support is where it involves the security of Israel

Spending

Please explain why you support or oppose federal subsidies?

Oppose. federal subsidies come with strings. The States give money in exchange for Liberty

What have you done, or will commit to do, to reduce federal spending? Where specifically do the cuts need to be made?

I lead the fight in Texas against the budget of the 83rd Session

I will fight for a balanced budget amendment that springs from 0 based budgeting

elimination of 6 agencies and trimming entitlement spending.

Taxes

What form of federal tax law do you support (e.g., current, flat tax, fair tax, other) and why?

flat tax 10%

Two deductions (charitable deductions and mortgage interest )

1st Amendment - speech, religion

Should private corporations be allowed to discriminate against potential customers based on their race, religious beliefs, sexual preference, or any other condition? Why or why not or under what conditions?

We don't need the heavy hand of government dictating morales in the free market.  People can vote with their feet as to what businesses they will or won't support.

2nd Amendment - guns

There have been several mass shootings in recent years. What, if anything, should the federal government do to solve this problem?

They can't solve it.  They can however encourage soft targets (schools) to become hardened targets by offering CLEAT training to teachers and administrators.

4th Amendment - searches

Under what conditions should the government monitor e-mail traffic for terrorist activity?

Only when an agent of the Federal government can obtain a warrant from a legitimate court for probable cause.

Please explain what types of information the government should be allowed to collect about individuals and their activities. Please be specific. What will you do to enable the collection of appropriate information and prevent the collection of inappropriate information?

At the Federal Level the only information that should be allowed to be collected is intelligence gathering that is warranted by a Federal judge where there is probable cause.  Warrantless surveillance activity is unconstitutional and must end.

I voted against the legal procurement of DNA and biometric signatures taken from  Class B Misdemeanor offenders.

10th Amendment

Please explain your interpretation of the Tenth Amendment and the principle of nullification. Do states have a right of nullification? What should the federal government do if a state attempts nullification?

The States have the right to nullification (State laws that nullify unconstitutional Federal laws) as well interposition.  Interposition is the act of a State ignoring unconstitutional Federal law. The powers left to the Feds are few and defined. Powers left to the States are vast.

Other civil liberty

Do you support or oppose requiring schools, public health departments or any medical personnel to secure consent from a parent or legal guardian before prescribing, dispensing or administering contraceptive drugs or devices to a minor?

Schools should NOT be permitted to have any involvement in decisions only parents should make with their kids

Do you support or oppose allowing a panel of qualified doctors to overrule the decisions of parents of a minor who has a serious medical situation and, if so, under what conditions?

I don't.

At what point should the "right to life" or "personhood" be granted to new human beings (e.g., at conception, birth, 5 days old, etc)? What action, if any, will you take to reflect this in law?

Conception to natural death should be defended.  I will continue to fight for the repeal of Roe V Wade

Economy

What are the pros and cons of central banking?    Please include in your discussion the Federal Reserve in particular and its policies and actions?

The Fed can take some of the bumps out of an economic down turn by means of its monetary policy.  The problem is that bubbles are often created making treatment more painful than the sickness.  The Fed needs to be audited.

Do you support "Free Trade Agreements", such as NAFTA? Why or why not?

I support free and open trade that is free of government subsidized goods that either subsidize the production cost or manipulate their currency to make their products less expensive.

Education

Please explain why you do or do not support Common Core.

I fought Common Core with the passage of the CSCOPE Transparency bill

type 2 education has failed our children

Environment

Do you believe that humans are a major contributor to climate change and if so, what action(s) should the federal government take?

no

Immigration

Please list all rights to which non-citizens are entitled.

Non-Citizens who come here legally are entitled to protection under our constitution.

Non-Citizens who come here illegally are not entitled to anything more that a bus ride to the border.

Other

What measures can Congress take to ensure the preservation of traditional family values and what is your commitment to fight for those measures?

defend traditional marriage, reduce taxes easing financial pressures in the family, be a good example of what a God fearing leader should look like.
